
Terms & Conditions
These Terms and Conditions form the basis of the agreement between you (the Client) and Eliza O'Sullivan Enterprises T/A Tea and Tusk Travel for the provision of travel services. ​

1. Definitions
In this agreement:

"Tea and Tusk," "we," "us," or "our" refers to Tea and Tusk Travel an Australian registered company.

"Client," "you," or "your" refers to the person(s) named on the booking confirmation.

"Booking" means the confirmed arrangement for travel services once a deposit is paid and acknowledged in writing by Tea and Tusk.
-
"Travel Arrangements" refers to the components of the tour organised by Tea and Tusk, including accommodation, transport, guides, and activities.
-
"Force Majeure" is defined in Clause 12.

2. Formation of Contract
2.1. A booking is confirmed when we receive your deposit and issue you a written confirmation.
2.2. By paying your deposit, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

3. Booking and Payment
3.1. A non-refundable deposit of 25% of the total cost is required to secure your place.
3.2. Full payment is due no later than 60 days before departure.
3.3. For bookings made within 60 days of the departure date, the full amount is payable at the time of booking.
3.4. Failure to pay on time may result in cancellation of your booking, with applicable cancellation charges (see Clause 7).

4. Pricing and Surcharges
4.1. All prices are quoted in Australian Dollars (AUD).
4.2. Prices are subject to change due to factors beyond our control, such as increases in taxes, fuel surcharges, currency fluctuations, or supplier costs.
4.3. Once full payment is received, your price is locked in and not subject to further adjustment.

5. Amendments by the Client
5.1. Requests for changes must be submitted in writing.
5.2. A fee of AUD $100 per person may apply for amendments, in addition to any costs imposed by suppliers.
5.3. Changes made within 60 days of departure may be treated as a cancellation and subject to cancellation fees.

6. Amendments by Tea and Tusk
6.1. We reserve the right to make changes to your itinerary due to unforeseen circumstances or safety considerations.
6.2. If a material change is required, you will be offered:
-
An alternative itinerary of similar value;
-
A credit towards future travel; or
-
A full refund of monies paid, less any unrecoverable costs.

7. Cancellation by the Client
7.1. Cancellations must be made in writing.
7.2. The following charges apply:
-
More than 90 days before departure: loss of deposit.
-
31–90 days before departure: 50% of the total tour cost.
-
30 days or less before departure: 100% of the total tour cost.
7.3. No refunds will be provided for early departures, late arrivals, or unused services.

8. Travel Insurance
8.1. Travel insurance is mandatory. Your policy must cover:
-
Cancellation;
-
Medical emergencies and evacuation;
-
Loss of luggage;
-
Disruption due to COVID-19 or other events.
8.2. Proof of insurance is required 7 days prior to travel.

9. Personal Requirements and Participant Responsibilities
9.1. You must inform us at the time of booking of any:
-
Medical conditions;
-
Mobility issues;
-
Allergies or dietary needs;
-
Other special requirements.
9.2. While we will endeavour to accommodate reasonable needs, not all requests can be guaranteed due to local conditions or supplier limitations.
9.3. Failure to disclose relevant information may result in cancellation of your participation without refund if we believe your involvement poses a risk to yourself or others.
9.4. It is your responsibility to ensure you are fit and able to complete the itinerary.

10. Liability
10.1. Tea and Tusk acts as an agent for various third-party suppliers. We are not liable for any acts or omissions of these providers.
10.2. To the fullest extent permitted by law, Tea and Tusk excludes all liability for any loss, injury, damage, delay or expense arising from your tour participation.
10.3. You acknowledge that participation in travel involves risks including, but not limited to, accidents, injury, illness, delays, or loss of personal property.

11. Client Responsibility for Additional Costs
11.1. You are responsible for all additional costs arising from, but not limited to:

Missed flights or connections;
-
Voluntary changes to the itinerary;

Medical treatment or evacuation;
-
Quarantine, isolation, or testing requirements;
-
Alternative accommodation due to travel delays;
-
Any government-imposed measures while travelling.
11.2. We highly recommend your travel insurance cover these eventualities.

12. Force Majeure
12.1. Force Majeure includes, but is not limited to:
-
Natural disasters (e.g. earthquake, flood, fire);
-
Acts of war, terrorism, or civil unrest;
-
Epidemics, pandemics, or public health emergencies;
-
Government restrictions or travel bans;
12.2. If a Force Majeure event prevents or materially affects our ability to provide the services, we will:
-
Notify you as soon as practicable;
-
Offer to defer or reschedule the trip, where possible;
-
Refund recoverable costs, if cancellation is necessary.
12.3. We are not liable for non-recoverable losses or additional costs resulting from a Force Majeure event.
​
13. Photography and Promotional Use
13.1. By participating in our tours, you grant Tea and Tusk permission to use images or video of you for promotional purposes unless you request otherwise in writing before travel commences.

14. Governing Law
14.1. These Terms are governed by the laws of New South Wales, Australia.
14.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
